Decision

The company, Merrydown plc, said that it complied with current labelling and trading standards requirements. The product pack size was considered and it was concluded that the 330ml size is not the sole preserve of soft drinks manufacturers and would not, of itself, lead to confusion of identity with soft drinks.

Merrydown’s move to drop the term ‘lemonade’ and rename the product ‘Alcoholic Lemon Brew’ was welcomed. The manufacturer stated that this new description will be in universal use on Two Dogs bottled products once old packaging stocks have been exhausted, and on cans as soon as current stocks of printed tinplate have been used.
